Talaq Talaq Talaq: instantaneous and irrevocable divorce

Read Time: 4 minutes

Shah Bano, a 62-year-old Muslim mother of five from Indore, Madhya Pradesh, was divorced by her husband in 1978. She filed a criminal suit in the Supreme Court of India, in which she won the right to alimony from her husband. However, the Muslim politicians mounted a campaign for the verdict’s nullification. The Indian Parliament reversed the judgment under pressure from Islamic orthodoxy.

After 41 years India has witnessed the victory for all these Muslim women who had been directly or indirectly having been suffered the most in the name of triple talaq or talaq-e-biddat or talaq-e- mughallazah(irrevocable divorce). The revocation of triple talaq has shown the way for one nation and one law. It has certainly purged the impurities which are marring Indian society for a long time. It is hard to believe such a stigma of society still persists in India. There was a time when movie maker could not put the name of the movie as triple talaq as it can simply jeopardize their marriage status by uttering the words by a husband.

Not only Muslims women, but in the case of Hindus women also, they do face the black horror of bigotry, superstition and social stigma since the dawn of history. Be it female foeticide, child marriage, dowry disgrace, women trafficking or gender inequality in every sphere of life, have ceded the developed India’s goodwill and harmony. According to sources in every hour 4 Indian women lost their modesty and that 117 million girls demographically go “missing” due to sex-selective abortions, as claimed by the United Nations Population Fund.

The historic landmark judgment which has unveiled the curtain of superstition and introduced the new legislation which makes the practice of instant divorce through ‘triple talaq’ among Muslims a punishable offense with 3-year imprisonment. The new law clarifies and invokes  ‘talaq-e-biddat’ or any other similar form of talaq having the effect of instantaneous and irrevocable divorce pronounced by a Muslim husband void and illegal. It makes it illegal to pronounce talaq three times — spoken, written or through SMS or WhatsApp or any other electronic chat — in one sitting.”Any pronouncement of talaq by a Muslim husband upon his wife, by words, either spoken or written or in electronic form or in any other manner whatsoever, shall be void and illegal,” the law says.

The road to glory has not been rosy as the All India Muslim Personal Law Board (AIMPLB) has argued that the Supreme Court does not have jurisdiction to strike down provisions of personal law, organizations calling for reform and Muslim women from various walks of life across the country have urged the court to declare triple talaq and polygamy as “un-Islamic”. In the past, courts have made discordant notes about the immunity enjoyed by personal laws.

In 1951, the Bombay High Court in State of Bombay versus Narasu Appa Mali held that personal law is not ‘law’ under Article 13 of the Indian constitution. The judgment was never challenged in the Supreme Court.  In Ahmedabad Women Action Group versus Union of India, the Supreme Court was asked to consider that unilateral divorce by talaq and polygamy violated Articles 14 and 15.

The Article 13 of Indian Constitution provides a constitutional basis to judicial review since it gives the Supreme Court or High Courts the authority to interpret the pre-constitutional laws and decide whether they are in sync with the principles and values of the present Constitution. A judicial declaration from a Constitution Bench under Article 13 that personal laws are liable to comply with the fundamental rights guaranteed by Constitution would bring religious law, even uncodified practices.

The instantaneous and irrevocable (triple talaq) divorce has certainly addressed such sectarian rules which are earlier hard to be touched and forget of curtailing or wiping out from the society. Time has come now and again to act upon such inadmissible and untouched principles which are definitely cursed for the society in this developing and holy nation.

The long-awaited triple talaq bill has finally been passed in Rajya Sabha today after its already been okayed from Lok Sabha. History has indeed been created as millions of Muslim women suffering from the fear and apprehensions of verbal triple talaq through phone, WhatsApp and in the direct conversation since the last seven decades have finally been freed from the patriarchal shackles. It’s indeed a great victory for the ruling BJP led NDA and women of the minority community of the country, especially those hailing from the lowest ebb usually harassed and traumatized by their husbands under the garb of giving them instant divorce by uttering Talaq thrice. In today’s voting that ended in the Rajya Sabha today after protracted debate amongst the opposition and ruling party MPs, the 99 MPs of the BJP and its allies voted in favor of the bill while Congress and others voted against numbering 84. Now since the Triple Talaq Bill would become a law after the signature of the president the erring husbands giving Triple Talaq would be penalized for three years rigorous imprisonment, the clause the Congress party and its leader in the Rajya Sabha were opposing tooth and nail. The Congress leader Ghulam Nabi Azad had unambiguously said that it will be forced to vote against the bill as it has a criminal provision for three years imprisonment for the erring husband but no guarantee of any financial support to the distressed family from the government in the event of the husband going to the jail thus leaving the woman and her children in crisis. What Mr. Ghulam Nabi Azad fails to understand is that some kind of deterrent is needed to prevent these erring husbands. Congress even tried to drag in lynchings and Godhra to this historic debate to sideline the main issue and to provoke.

The prime minister Narendra Modi said that the medieval practice has finally come to an end and oppressed women of the minority community freed from the age-old traditional shackles of instant triple talaq. Prime minister Narendra Modi tweeted: An archaic and medieval practice has finally been confined to the dustbin of history. Parliament abolishes Triple Talaq and corrects a historical wrong done to the Muslim women. The opposition tried its best to provoke the Muslim community starting with Congress, calling it an agenda against Muslim men. The rejected and dejected opposition tried its best to provoke the Muslim community right from Parliament to social media.

He tweeted again: This is an occasion to salute the remarkable courage of those Muslim women who have suffered great wrongs just due to the practice of Triple Talaq.

The abolition of Triple Talaq will contribute to women empowerment and give women the dignity they deserve. The prime minister also thanked the opposition parties for making this possible. PM Narendra Modi’s earlier tweet says: I thank all parties and MPs who have supported the passage of Muslim Women ( Protection of Rights of Marriage) Bill 2019 in both the houses of parliament. They have risen to the occasion and this step of theirs will forever be remembered in India’s history.
President of India Ram Nath Kovind also congratulated on the occasion of the passing of the Triple Talaq Bill in Rajya Sabha today. In a tweet he said:

The passage in the Rajya Sabha of Muslim Women ( Protection of Rights of Marriage) Bill completes Parliament’s approval of a ban on the inequitable practice of Triple Talaq.

The president of India expressing his jubilation over the passage of the bill in the upper house termed it a milestone in the quest for gender justice and a moment of satisfaction for the entire country. The President Ram Nath Kovind tweeted: Passage in the Rajya Sabha of Muslim Women ( Protection of Rights of Marriage ) Bill completes Parliament’s approval of a ban on the inequitable practice of triple talaq. A milestone in the quest for gender justice; a moment of satisfaction for the entire country.

Historic day and a giant step in the empowerment of Muslim women and a slap on the face of those who engage in fearmongering. A historic blunder set right. Muslim women celebrate this historic day.

Five chief ministers meet to jointly fight increasing drug menace

Chief minister of Five States in a conference to effectively counter drug menace in India held at Chandigarh
Spread the love
Read Time: 4 minutes
The drug menace has once again assumed multi-pronged proportions at the pan India level with the border states of Punjab and Haryana including Uttar Pradesh and several other states of the country becoming  its victim as the younger generation, in particular, is constrained to ruin its future by falling into the trap of increasing drug menace.
What is a most worrisome aspect of this menace is, it’s accompanying huge illegal profits which are used by the terrorists and drug smugglers aided and abetted by ISI from across the border through porous Rajasthan and Punjab borders via Pakistan and Gorakhpur and Bihar etc via Nepal.
Not only this but these days the coasts of Srilanka, Maldives, and India are also being misused by the dreaded international smugglers to smuggle massive contrabands of the heroine in India which costs one crore for a kilogram in the international market and therefore fetches huge profits.
The Indian authorities, the BSF and the Narcotics Control Bureau, etc have caught more than five hundred kilograms or even more Heroine ( drugs) during the past years being smuggled in Punjab from Pakistan and Indo Pak Punjab border. This is indeed a very disturbing trend.
This heroine from here is sent through clandestine couriers to various metropolises and states of the country which is sold in grams at million and million of outlets like colleges, schools, hotels, discos and even in JJ clusters and unauthorized colonies. Once the addiction of the rich and affluents this menace has now percolated down to the boys of the lowest ebb of the society creating havoc with their lives.
Even states like Uttarakhand once considered to be the abode of Gods are today not free from this menace where the young generation have fallen prey to this dreaded addiction not only spoiling and ruining their health but also careers and families.
In order to establish strong coordinated efforts to stringently and decisively counter this increasing menace and bring the culprits ( drug mafia)  to justice with a heavy hand the chief ministers of five states sat together in a conclave at Chandigarh, the joint capital of Punjab and Haryana to arrive at unanimity to devise  a foolproof and credible solution to this dreadful menace.
This was the 2nd regional conference attended by CM of five states to counter the increasing challenge of drug menace and devise strategies to counter them credibly at the regional as well as at national level.
The conclave titled ” Conference on Drug menace, Challenges and Strategies” was attended by Haryana CM Manohar Lal Khatter, Uttarakhand CM Trivendra Singh Rawat, Punjab CM Capt Amrinder Singh, Himachal CM Jai Ram Thakur, and Rajasthan CM Ashok Gehlot, etc.
Apart from the chief ministers of five Congress and BJP ruled states heads of the police departments and Narcotics Control Bureau and other law enforcing agencies including officers from the North East and  J & K  were also present on this occasion.
The chief ministers expressed serious concern over the increasing drug smuggling from countries like Nigeria, Afghanistan, Pakistan and other nations of the globe and resolved to set up a credible  joint working group of seven Northern states and union territories which will mutually share information and experience involving officials of the Health and social welfare departments  to put the drug menace to end.
A nationwide campaign will also be launched to create awareness as well as bringing the culprits to justice through a widespread national campaign.
The chief ministers of Punjab, Haryana, Uttarakhand, Himachal Pradesh and Rajasthan including top officials of Jammu and Kashmir pledged to end the scourge of drugs by all means in order to protect the health and future of the young generation falling into the trap of this dreaded menace.
The conference also appealed to the center to bring out a credible drug policy to effectively and stringently deal with the drug scourge and menace by introducing effective laws.
THE states of HARYANA and Himachal Pradesh said they will introduce legislation on the lines of MCOCA ( Maharashtra Control of Organised Crimes Act ) to get rid of increasing drug menace.

Shame on the Gujarat government and its administration that its chief minister Vijay Rupani has valued the life of a dead in Surat fire for merely Rs four lakhs.

The Gujarat chief minister Vijay Rupani has announced Rs four lakh as compensation amount for the bereaved family of each of the dead in the massive fire in Surat Gujarat.

The toll till now has reached to 20 n several others seriously injured. Cases have been registered under relevant sections of IPC against the builder and the owner of the coaching centre for violating the building n fire rules/ by laws.

The furious and highly angered relatives n near n dear ones of the deads have raised anti Modi slogans when the Gujarat CM Vijay Rupani n the health minister reached the spot.

They’ve angerly argued n complained that the administration haven’t responded in time n adequately to save the lives of students trapped in this massive fire as number of the immolated students were constrained to jump from the top floor killing themselves on the spot.

There were not sufficient number of fire tenders and other equipments. The disaster management officials were conspicuous by their absence.

This apathetic behaviour n attitude of Surat administration has resulted in 20 deaths say the furious onlookers and the relatives of those who’d succumbed to fire injuries.

On the top of that the financial compensation announced by the state CM Vijay Rupani was merely Rs 4 lakh for each of the dead which is considered to be a tip of an iceberg or peanuts.

Souds immensely shocking that a government that has been accorded a historic majority by the people of the country n Gujarat exhibits so much of indecency n harsh behaviour towards the deads of the massive Surat fire. There is tremendous opposition n anger in the public for the extremely poor show in saving the fire victims n coming to their rescue in time.

The youth volunteers of Uttranchal Bhratra Sewa Sansthan based at ( in) Delhi are doing a novel job of cleansing the Nigam Bodh Ghat cremetorium at the Yamuna riverside in Delhi, situated opposite the famous historic old Hanuman Temple at Kinari Bazaar, just twenty minute walk from Kashmiri gate Bus terminus.

About two dozen volunteers wearing their organisations’ orange colured T shirt arrive at Nigam Bodh Ghat cremetorium usually on Sundays or on holidays with brooms n cleaners and dedicate themselves to clean the entire area to ensure that it becomes neat n clean devoid of rubbish n filth.

The selfless volunteers of this NGO/ social organisation also manage adequate sitting arrangements like community benches, water taps n other facilities etc from the donors who are approached by the volunteers of this organisation.

In these days of materialism and hectic involvement, when human beings are busy minting money n running behind comforts, selfless volunteers Uttaranchal Bhratra Sewa Sanstha are undoubtedly doing a yeomen service by keeping the Nigam Bodh Ghat crematorium neat and clean n also providing amneties for the convenience of the people coming here for bidding last adieu to their near and dear ones. Such a selfless social service indeed deserve myriad appreciation.

According to one of the volunteers of this organisation Akhilesh Bhatt such activity and selfless service accords them immense internal satisfaction and pride to do something concrete for the place where one day each n every person has to come to bid final adieu to this materialistic world.

It may be recalled that hundreds of dead bodies arrive here on daily basis for performance of last rights according to the Hindu traditions.

The MCD n Delhi government in league with several socio religious organisations are looking after the maintenance and cleanliness of Nigam Bodh Ghat.

But despite the best efforts of the stakeholders it still gives a sorry look and the Yamuna river alongside is also extremely filthy n polluted.

Selfless social organisations like Uttaranchal Bhratra Sewa Sangathan volunteers are indeed a source of inspiration for others to follow suit n deserve kudos. They want to bring the Ghat to the standards of Haridwar ghat in the days to come.

Uttarakhandies has a sizeable population in Delhi and Nigam Bodh Ghat is also used by them to perform the last rights at the riverside of the ghat whereas other communities use the sheds n inner area to perform last rights here.

No trace of mysteriously disappeared 14 yr old Mohit Kathaith from Vaishali even after three days

Mysteriously missing Mohit Kathaith from Vaishali, Ghaziabad

Read Time: 3 minutes

A fourteen year old boy, student of class 9th of Police Modern School, Vaishali, Ghaziabad is missing for the last three days and his where abouts are still unknown.

Mohit has gone missing from Sector three Vaishali since 1st of May when he started for his school on foot at 8 AM as the school is hardly 1.25 kilometres away from his residence.

His mysterious dissapearence has raised doubts in the minds of his traumatic family members including his parents.

Son of father late Gambhir Singh Kathaith and mother Sarita Kathaith, Mohit was also carrying a mobile phone with him which is now going switched off. The number of his mobile phone is : 7838913388.

According to his widowed mother, after leaving for his school just after half an hour on May first morning probably at 8.30 AM Mohit had informed that he had reached the school.

But after confirming from the school authorities it was ascertained that Mohit had’nt come to school on 1st May, contrary to the statement of disappeared Mohit who according his mother had confirmed about reaching the school.

It however remains to be seen whether Mohit told the truth or he was lying.

However, Mohit’s mother who is a hapless widow, tried to contact him on his mobile phone, several times but it was shut down.

The confused and tormented widow Sarita Kathaith, thereafter tried their level best to search him at all the possible locations like his friends place and the homes of relatives, but of no avail.

Failing in their constant attempts to trace their mysteriously dissappeared son Mohit Kathaith who is still an adolescent the bothered mother n immediate relatives went to the police to request them lodge the FIR and energise their efforts to trace him but of no avail initially.

The local police informed the parents on 1st evening that a written report has been filed in the police post of Vaishali n that they are trying to search the missing boy but of no awail and finally on 2nd May evening the FIR regarding the missing 14 year old Mohit Kathaith was registered in the Indirapuram Police Station.

While the Indirapuram police is trying its best to search the missing 14 year Mohit, his relatives, near n dear ones n the neighbours are also trying hard to locate him but in vain.

Almost 72 hours has elapsed and there is no clue about mysteriously missing adolescent Mohit.

This certainly raise question mark on the so called efficiency and the apathy of the police authorities.

Had they been serious enough they could have traced him by now.

It may be recalled that similarly a 5 year old girl Kashish Rawat was mysteriously found missing four years ago from Ghaziabad and despite serious efforts by umpteen number of social organisations of Uttarakhand in Delhi n UP including lodging of FIR n handing over of the case to crime branch she is still at large which unambiguously speaks of the ignorance and apathetic attitude of the police authorities in searching mysteriously missing children in Ghaziabad location.

JUDICIARY IN JEOPARDY

Read Time: 2 minutes

It has been 70 odd years since the dawn of Independent India but hard to heed such a sensitive case against none other than the numero uno of Indian judiciary. What about the ordinary citizens like you and me. Who will be the savior of our democracy?

On April 20, 2019, Honourable CJI was maligned by a shameful sensitive sexual harassment allegation by none other than his colleague. After a tumulus high voltage drama of one and a half week, the plaintiff has decided to pull out of the case due to the shaky and frightening environment. Irrespective of truth, it is hard to heed such a sensitive case in the chapter Indian Judiciary history.

It is not the first time the image of judiciary tarnished, there are several instances in the past which hard to reveal the harsh reality. Be it V Ramaswami way back in 1993 for alleged corruption, in 2011  Calcutta high court judge Justice Soumitra Sen, guilty of financial misappropriation as a judge and misrepresentation of facts, in 2006 Nagarjuna Reddy of the high court of Andhra Pradesh and Telangana for misusing position to victimize a Dalit Judge. In a recent shocking event, another Calcutta High Court Judge Justice C S Karnan became the first sitting judge  of a high court to be jailed for defamatory remarks against the judiciary, seems to be countless instances(PTI sources)

Now the big question arises why such defamatory allegations have been cropping up from time to time in Indian judiciary chapter. Does it mean because of a few handfuls of maligned citizens of India people won’t get an impartial and independent trial and hearing in their cases? No, a common man view and perspective won’t change. Still, people in India feel safe by speaking the sentence “I will see you in the court.”It is an august and unparallel system which always bodes well for all of us in crisis time. We urge our esteemed judiciary to introspect their shortcomings and adversaries in upcoming periods. It must try to reinstate the faith and fear of an ordinary Indian. As they say “Justice delayed is justice denied”.

Why is it that people who are involved transparently n with utmost dedication to reform the society and educate children of the poor, economically deprived n marginalised classes of the society are called by the Almighty as such a young age especially when the mission of these pro active education volunteers remains’ incomplete.

One such dedicated and a visionery woman namely Kamala Gariya has unfortunately left for her eternal journey ( heavenly abode) leaving her selfless mission to depart quality education to the children of remote areas of the Uttarakhand hills in between.

However, she has passed the baton of her unfinished tasks to her husband Bharat Gariya and other dedicated teachers of a private school called Angel’s academy functioning at the distant rural area like Bageshwar’s Kapkot vicinity where twelve years ago the local village children were struggling hard to acknowledge quality english medium education at cheaper rates.

In the absence of education, especially the quality education, majority of the families of the surrounding villages were constrained to leave their villages thus shifting to local towns n metropolises.

Late Kamala Gariya, keeping in view the genuine requirement of a school to impart cheaper quality education opened a school known as Angels’ Academy which imparted quality education to hundreds of children now studying in good number of prestigious Navoday Schools, Sainik School Ghorakha n Himjyoti Dehradun.to seed higher education in various desciplines of their choice.

The school also ensures that the students are taught local languages, how to preserve their cultural n folk heritage including to be outstanding singers, actors n sportsmen in the near future.

It was due to the dedicated hard work, vision and enthusiasm of late educationist Kamala Gariya that schools like Angel’s academy are imparting quality founding education in the remotest corners of Uttarakhand where unfortunately government schools running with extra budgets are being closed for the lack of quality education.

The children of Angels’ Academy School also send Rakhies to the Armymen guarding our porous borders on Rakhabandhan days every year. Our heartfelt tributes to educationist Kamala Gariya.
