Delhi has undoubtedly become a crime capital topping in terms of statistics and this fact has been unambiguously furnished by one of the prestigious newspaper of the country. The electronic channels and their reporters eloquently deliver various incidents of shameless crimes, rape of women including the adoloscents being the worst victim with increasing gangsterism, not to speak of the 38 thousand cases of chain snatching and thefts registered with the Delhi police during the last few years. Overall situation of a Delhite, particularly the women community is extremely vulnerable with no guarantee of their safety and security in majority of the shameless obnoxious incidents of women assaults.

The most uncalled for brutal incident of repeated merciless thrashing of a woman with iron rods after illegal confinement and a police woman in uniform having been publicly dragged in Narela by the dubious charactered women involved in a massive illicit liquor trade while the onlookers, majority of them being the male members not having the guts to come to the rescue of the victm, has made one thing absolutely and unambiguously for guaranteed that the criminal elements and those involved in the illicit liquor trade in the rural surroundings are least apprehensive about terror of the law enforcement agencies and everybody is scare of them despite the fact that its the capital city of India where law and order is always on the alert as claimed by the Delhi police. There have been accusation by the AAP and the Delhi Women Commission including the Delhi Chief Minister Arvind Kejrival that the horrified woman victim was also paraded naked by the criminals and illicit botteleggers who did their best to ensure that the whistle blower woman is taught a most serious lesson by incessantly beating her in public with iron rods and even shamelessly dragging a woman policemen by hair.

The severely injured woman is badly horrified while being treated in hospital where the Delhi CM Arvind Kejrival met her and also approached the Delhi’s LG in person to demand strictest punishment to the guilty and provision of adequate security to the victim who’d bravely tried to expose the illicit liquor trade in Narela as a courageous whistle blower. However, the DCP of the Zone has given all assurances to try the guilty women under the strictest sections of the law but the point is how long will the whistle blowers of the society whether in Delhi or in other parts of the country continue to be the victims of criminals or supari killers and when would are state legislatures or the union government devise a strong and strict law for the safety and security of whistle blowers and RTI activists who risk their precious lives for the good of the society but are brutally killed or grievously injured with no governmental safety apparatus.

The incident of incessant thrashing of the woman volunteer exposing the illicit liquor trade in Narela in outer district by the criminals involved in the liquor trade is an unambiguous example of the increasing loss of the terror of law enforcing agencies particularly the police in the eyes of the latter ( criminals) who freely operate allegedly in league with the local law enforcing authorities and therefore feel that they are immune to any legal action. One can easily come to the conclusion through such brutal incidents of attacks on women in broad day light with her alleged naked parade, that the law breakers in the capital have become more and more over confident to commit lawlessness of gigantic nature sending a clear signal that they are least terrorised by the police authorities.

This most shameful incident of a whistle blower women including a police women in uniform being physically assaulted and grievously injured in broad day light with nobody having the courage to counter them is a terrible commentry about the worsening law and order situation in the nation’s capital and a wake up call for one and all as well. What do you say friends?

Rape is the most extreme and extremely violent form of control over female bodies and their personal space.

The mind-set in India regarding rape tends to put the blame on women. Many women do this too, because that is what they have been conditioned to do. The suggestion that female dress and behaviour ‘cause’ rape is outrageous. And more outrageous is the fact that this argument takes place in developed countries like the U.S. also.

Men sometimes try to judge a woman on the basis of what she wore, or ate, or drank, or where she was, etc. This judgment is then turned by men into surveillance of women’s bodies. Sometimes it converts into ‘male’ rape mind-set, which is basically a struggle for about control. Rapes do not to occur just because a man cannot ‘control’ himself, they occur because some men want to control women. Rape is the most extreme and extremely violent form of the control over female bodies and their personal space. Most disgusting is the fact that this is generally practised by many men in ‘moderate’ and ‘peaceful’ atmosphere of their everyday lives.

Most cases of rape take place because some men can’t accept the fact that women should have equal rights to dress, move, work, play or enjoy. Sometimes they take place because some men can’t accept a ‘no’ by a woman. Throwing acid is a common strategy adopted by ‘Romeos’ on a girl who does not show interest in him, or on a woman who rejects her lover. This is a very common part of this continuum of sexual assault.

The only way to stop rapes is to empower the agency of women and not hinder it at all. This includes, above all, the freedom to do with their own bodies what women wish in terms of dress, food, and even sexuality. Only then we will be able to free our society from this curse.

Supreme Court on Tuesday declared talaq-e-biddat or instant and irrevocable talaq as a "manifestly arbitrary" practice.

In a 3:2 majority, Supreme Court on Tuesday declared talaq-e-biddat or instant and irrevocable talaq as a “manifestly arbitrary” practice. According to the SC, it is not protected by Article 25 of the Constitution which provides freedom of religion.

Chief Justice J.S. Khehar, who led the Bench, said that talaq-e-biddat is an integral part of Article 25 (freedom of religion). He also said that instant talaq does not violate the Constitution, and said it is the responsibility of the legislature to decide a law within six months. This view was also endorsed by Justice S. Abdul Nazeer.

The Chief Justice, however, also said that even the Muslim world has shed talaq-e-biddat and there is no reason for an independent country like India to lag behind. He has appealed to political parties and lawmakers to set aside their individual profits and give frame a new, suitable law.

Justices Kurian Joseph, U.U. Lalit and Rohinton Fali Nariman gave separate judgments against the validity of instant talaq. According to Justice Nariman, talaq-e-biddat  allows a Muslim man to “whimsically and capriciously”  divorce his wife. The practice according to him is “manifestly arbitrary” and does not enjoy the protection of Article 25.

Justice Kurian differed with Chief Justice Khehar and said that just because a practice has been around for 1,400 years, this fact does not make it eligible for protection under Article 25 of the constitution. Justice Kurian also started an uproar by suggesting an alternative that a Muslim bride, should be allowed to lay down a condition in the nikah nama that, in case the marriage hits a rough patch she would not be subjected to instant talaq.

The All India Muslim Personal Law Board (AIMPLB) holds that triple talaq is a matter of faith followed for 1400 years. The Centre had always claimed that instant talaq was not fundamental to Islam and it has promised to bring a new divorce law for Muslim.

Dowry is a cancer to the society.

The Anti-dowry law of 1961 had sought to protect women from being killed or tortured in their marital homes. Section 498A of the IPC makes dowry harassment cognisable and non-bailable offence.

However, an argument was raised that Section 498A is widely misused by disgruntled women who are determined to destroy family values and drag completely innocent husbands and in-laws to jail. The Supreme Court has observed that women are using Section 498A as a weapon, rather than a shield, against their unfortunate in-laws. Court has acknowledged that most of such complaints are filed in the heat of the moment, over trivial issues.

To protect the victims of false accusations, the court:

  • In a 2014, provided a nine-point checklist before any arrests could be made under Section 498A.
  • Mandated a family welfare committee in every district to scrutinise dowry harassment cases, constituted of social workers.
  • Removed the need for the accused to make a personal appearance in court.

These orders came after Justice C.K. Prasad noted that in 2012 two lakh arrests were made under Section 498A, with only 14.4% of conviction rate. Based on this, the judges conclude that the complaints were for the most part “trivial”.

24,771 dowry deaths have occurred in India from 2012 to 2014 making Section 498A vital for the protection of genuine victims. Every law has the potential to be misused and because of such cases the pleas of genuine victims are gone unanswered. Strong regulations are to be laid down if the rights of women are to be upheld and diluting the Anti-dowry law is not one of them.
